1. Acceptance
By accessing or using indiaproplaw.com ("Portal"), creating an account, purchasing a membership, a library item or a legal service, you agree to be bound by these Terms of Sale & Use ("Terms"), read together with our Privacy Policy and Refund Policy. If you do not agree, please do not use the Portal.
2. About us
The Portal is operated from India and governed by Indian law including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology Act, 2000, the DPDP Act, 2023 and applicable tax legislation.
3. Eligibility
You must be at least 18 years old and competent to contract under Indian law. Where you use the Portal on behalf of an organisation, you represent that you are authorised to bind it.
4. Account
- You are responsible for the confidentiality of your login credentials.
- You must provide accurate, current information and keep it updated.
- We may suspend or terminate accounts for breach of these Terms, fraud or unlawful use.
5. Editorial content — not legal advice
News, articles, judgments summaries and updates published on the Portal are for general information only and do not constitute legal advice or create an advocate–client relationship. For advice on your matter, please book a paid consultation.
6. Memberships & subscriptions
- Memberships are personal, non-transferable and auto-renew unless cancelled before the next billing date.
- Prices are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise.
- Members may access subscriber-only content for the duration of the active plan.
7. Library & digital products
Templates, e-books, courses and other digital items in the Library are licensed, not sold. You receive a non-exclusive, non-transferable licence to use them for personal or internal professional purposes. Redistribution, resale or reverse-engineering is prohibited.
8. Legal services
Where you engage us or our empanelled advocates for drafting, vetting, opinions, NRI advisory or consultations, a separate engagement note will govern scope, fees, timelines and confidentiality. All professional work is subject to the Advocates Act, 1961 and the Bar Council of India Rules.
9. Payments & taxes
- Payments are processed by authorised payment gateways. We do not store full card / UPI details.
- GST invoices will be issued for taxable supplies. Please enter correct GSTIN for input credit; we cannot reissue invoices with retroactive GSTIN.
- You are responsible for any FX or bank charges on cross-border payments.
10. Cancellation & refunds
Refunds, where available, are governed by our Refund Policy.
11. User content & conduct
- You may not post unlawful, defamatory, infringing or misleading content.
- You grant us a non-exclusive licence to host and display content you submit (e.g., comments, queries).
- We may remove content and report unlawful activity to authorities under the IT Rules, 2021.
12. Intellectual property
All content, design, trademarks and logos on the Portal are owned by us or our licensors and are protected by the Copyright Act, 1957 and the Trade Marks Act, 1999. No content may be copied, republished or used for AI training without prior written permission.
13. Disclaimers
The Portal is provided on an "as is" and "as available" basis. We do not warrant uninterrupted operation or that the content is current, exhaustive or free of errors. Judicial decisions and statutes change frequently; verify before acting.
14. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of the Portal or any paid service shall not exceed the amount you paid to us for that specific service in the 12 months preceding the claim. We are not liable for indirect, incidental or consequential losses.
15. Indemnity
You agree to indemnify and hold us, our directors, employees and empanelled advocates harmless from claims arising out of your breach of these Terms or violation of applicable law.
16. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to arbitration where applicable, courts at New Delhi shall have exclusive jurisdiction.
17. Grievance redressal
For complaints regarding the Portal or any transaction, write to our Grievance Officer at hello@indiaproplaw.com. We will acknowledge within 48 hours and endeavour to resolve within 30 days, as required under the Consumer Protection (E-Commerce) Rules, 2020 and the IT Rules, 2021.
18. Changes to Terms
We may revise these Terms. The updated version becomes effective when posted, and continued use signifies acceptance.
