What This Service Is

When someone gives you a Gift Deed, a WILL, a Relinquishment Deed, or a Partition Deed, you need an independent legal review. This review checks every clause, the property's history of ownership (the "title chain"), and any stamp duty and tax effects. A document might look simple but could have a condition, a missing part, or a problem with the ownership history (a "title defect"). These issues could lead to expensive lawsuits years later.

What the Service Entails

Reviewing a family property transfer document is more than a simple checklist. It requires an independent look at the property's ownership history, and whether everyone signing the document has the legal right to do so. We also check if the document follows the relevant laws, stamp duty rules, and income tax provisions. IndiaPropLaw will examine the document anew using all the ownership papers you provide. We will find any differences in the property description or who owns it. We will confirm that everyone with a legal claim has signed or agreed. We will also check if the stamp duty has been calculated correctly. We specifically review income tax implications, such as Section 56 exemptions (rules that exempt certain income from tax), capital gains (profits from selling an asset) on a gift or relinquishment, and clubbing provisions (rules that combine income of related parties). These might be things the original drafter missed. We will share a Preliminary Vetting Report that lists every issue we find, pointing to the specific clause and the relevant law. After we discuss our findings and your options (like negotiating changes, refusing to sign, or accepting certain risks), you will receive a Final Vetting Report. This report will combine all findings and recommend changes.

Our Specialized Inputs

We apply the same strict ownership history check that major lenders use for property loans. We do this for every individual family transfer. We examine government land records (revenue records), previous sales documents (prior conveyances), court orders, and inheritance papers (succession documents). This helps us confirm that the person signing the document has clear authority to do so. We also ensure that no one else has conflicting rights. Specifically for WILLs and Relinquishment Deeds, we check if all necessary parties have signed. If a co-inheritor or a joint owner (coparcener) is missing, the entire document could become invalid.

What you'll receive

  • You will understand the full meaning of an absolute transfer in a Gift Deed. We will help you determine if it's a gift or a sale.
  • For WILLs, we will assess if the person making the WILL has the legal capacity to do so. We will also check the appointment of the executor (the person who will manage your estate). We will confirm if the WILL is ready for probate (the legal process of proving a WILL's validity).
  • For Relinquishment Deeds, we will analyze each co-inheritor's share. We will clarify if money was exchanged or if it is a pure relinquishment.
  • For Partition Deeds, you will receive a clear schedule (list) of how the property is divided. We will also calculate the shares. We will guide you through the process of updating land records (mutation).
  • You will receive advice on how to optimize stamp duty (reduce the tax paid on property transfers). We will also give you a checklist for registering each type of document.

What we'll need from you

  • Tell us the type of document you need: a Gift Deed, a WILL, a Relinquishment Deed, or a Partition Deed.
  • Provide the names, relationship, and contact details for everyone involved in the document.
  • Give us a description and all ownership documents for the property being transferred.
  • Let us know if any money is involved, or confirm that no money is being exchanged.
  • Provide PAN cards (Permanent Account Number, a unique identifier for tax purposes) and Aadhaar cards (a 12-digit unique identity number) for everyone involved.
