Vetting of Claims under Real Estate Disputes (RERA, Consumer Courts, etc.)
Expert drafting of complaints and claims in real estate disputes — RERA complaints, consumer forum petitions, IBC applications, and civil court plaints for builder delays, defects, refund demands, and possession enforcement.
What This Service Is
Before you file a claim in a RERA, Consumer Court, or civil property dispute, we check it for you. This makes sure every amount you claim for losses is correct. We also confirm the law supports each part of your claim. This helps your claim be structured so the court can give you the full amount you request.
What the Service Entails
When we check your real estate claim document (for RERA, consumer court, or civil court), we confirm your losses are calculated correctly. We use the right legal formula for each situation. We also make sure your supporting documents are organized. This allows the court to easily check them.
For example, we review the interest calculation under RERA Section 18 — this is the part of the RERA law that deals with interest payments. We check the correct interest rate, how interest is compounded (calculated on the previous interest), and the start date for interest. Mistakes in any of these can greatly reduce the money you get back.
For consumer court claims, we check if your method for claiming compensation for mental distress and other losses follows past court decisions. We first share a Preliminary Vetting Report with you. After we discuss your plan to enforce the claim and any missing information, we deliver a Final Vetting Report. This report will include changes marked directly on your document.
Our Specialized Inputs
We specifically check the RERA Section 18 interest calculation. This is the most common mistake in claims from homebuyers. The correct formula (outstanding principal × MCLR + 2% × days outstanding / 365) applied from the correct date of default often results in a much larger amount than what you might first calculate.
