What This Service Is

This service helps you check a valuation defense petition. This is a document explaining why you disagree with a property value. You or your team will prepare the petition. We then review it before you send it to the Collector of Stamps or the Additional Registrar. These are the government officials who decide on property value disputes. Our review makes sure you use all the right technical and legal arguments. It also ensures your Valuation Report — a document from a professional expert valuing your property — is clearly presented in your legal submission.

What the Service Entails

When we vet (review) your defense petition, we check if your challenge to the "circle rate" is technically correct. The "circle rate" is a minimum property value set by the government for stamp duty calculations. This rate changes based on your property's use (for example, residential or commercial), its floor, and its location. The Sub-Registrar — the government officer who registers property sales — uses these factors to apply the circle rate. IndiaPropLaw checks your petition for several things:

We confirm the circle rate challenge for technical accuracy. We see if your Valuation Report directly addresses the specific reasons the Sub-Registrar questioned the property value. We also check if your comparable sales information (proof of similar property sales) comes from reliable sources, ideally the Sub-Registrar's own records. Finally, we ensure your petition follows the correct format for the specific authority hearing your case (either the Collector of Stamps or the Additional Registrar).

You will first receive a Preliminary Vetting Report. This report summarizes our initial findings. After we discuss this report and help you prepare for your hearing, we will give you a Final Vetting Report. This report will include our recommended changes.

Our Specialized Inputs

We specifically check that the circle rate category matches your property's correct classification. It's common for the Sub-Registrar to make mistakes. For example, they might apply a commercial rate to a residential property. Or they might use a higher floor multiplier than your property's actual floor. These misclassifications are often the easiest way to challenge their valuation.

What you'll receive

  • We will compare the government's guideline value with the actual market value of your property, using data from similar sales.
  • We will help you identify technical reasons to object to how the authorities valued your property.
  • We will draft your reply to the show-cause notice (a formal letter asking you to explain yourself) and include supporting documents.
  • We will represent you before the Inspector-General of Registration, the senior official overseeing property registration.
  • If the valuation order is upheld, we can help you with an appeal to the Revenue Board or the High Court.

What we'll need from you

  • Provide a copy of the notice you received from the Sub-Registrar or Inspector-General of Registration.
  • Give us your original sale deed or the property transfer document being reviewed.
  • Tell us the circle rate (government-set minimum value) for your property when you registered it.
  • Share any supporting valuation evidence you have. This could be a report from a registered property valuer, details of comparable sales, or general market data.
  • Send us all letters or communications you have already exchanged with the stamp duty authority.
