Vetting of Original Complaint — RERA / IBC / CPA 2019
Vetting and vetting of original complaints and applications before RERA, Consumer Forum (CPA 2019), NCLT (IBC 2016), Apartment Owners Associations, and Registrar of Cooperative Societies. Includes cause-of-action analysis, relief structuring, and annexure preparation.
What This Service Is
Reviewing your complaint before you file it is the best way to ensure it's strong. Even a good complaint can be rejected or delayed if it's filed incorrectly. This includes using the wrong court, citing the wrong laws, or not including all necessary documents. We provide an expert review of your completed complaint draft. This happens before you submit it to the Real Estate Regulatory Authority (RERA), the National Company Law Tribunal (NCLT), the Consumer Commission, or any other court.
What the Service Entails
Reviewing your complaint before you file it is the most effective way to ensure its quality. We check every part of your draft. This includes: the court's power to hear the case (jurisdictional basis), the specific laws you've mentioned (statutory sections cited), and if your facts are complete and in order (factual averments).
We also check how you've calculated each claim, your request for what you want the court to do (prayer clause), the format of your sworn statement (affidavit), and your list of documents (document index). We compare these against the specific rules of the court you are using. We ensure your complaint meets the requirements of online filing portals. These include HRERA for Haryana, UPRERA for Uttar Pradesh, and Delhi RERA. We also make sure your evidence is presented in a way that the judge (Adjudicating Officer) will understand.
You'll first get a Preliminary Vetting Report. This report will show specific problems and suggested changes, marked in red. After we discuss these findings, we'll give you a Final Vetting Report. This will include your complaint with all the suggested changes, still marked in red.
Our Specialized Inputs
We know how RERA and the Insolvency and Bankruptcy Code (IBC) work in practice. This means we review your complaint based on what judges actually expect, not just what the law says. We make sure your complaint is formatted correctly for specific online portals. These include HRERA for Haryana, UPRERA for Uttar Pradesh, and Delhi RERA. We also ensure your evidence is arranged in a way that the judge (Adjudicating Officer) will review it effectively.
What you'll receive
- You'll understand the legal reason for each claim (cause-of-action). This includes penalties for delays under Section 18 of RERA, the Real Estate (Regulation and Development) Act, 2016, and how to structure a refund request.
- We'll help you confirm if your claim value is correct for the Consumer Protection Act, 2019 (pecuniary jurisdiction). We'll also help you clearly state the service issues (deficiency of service) or unfair business practices (unfair trade practice framing).
- We'll clarify if you are a financial or operational creditor under IBC 2016, the Insolvency and Bankruptcy Code, 2016. We'll also help you determine the exact amount owed (default amount) and draft the correct forms (Form 1/5).
- We'll help you address violations of community rules (bye-law breach), membership issues, or disputes about elections under the Apartment Owners Act or Cooperatives Act.
- We'll help you calculate the relief and compensation you are seeking. We'll also provide a checklist of supporting documents you'll need.
