Power of Attorney for NRIs — Drafting, Apostille, Adjudication & Registration
End-to-end Special/General Power of Attorney for NRIs — drafted for the Indian sub-registrar, executed before the Indian consulate or apostilled in Hague Convention countries, adjudicated under Section 32-A of the Indian Stamp Act, and registered in the property's jurisdiction.
What this service is
A Power of Attorney (POA) executed abroad lets a trusted person in India sell, buy, lease, register, litigate, or operate accounts on your behalf — without you flying back. We handle the full chain:
- Drafting — Special POA (transaction-specific) or General POA, with the right powers and the right limitations.
- Execution abroad — at the Indian consulate (for non-Hague countries) or by local notary + apostille (for Hague Apostille Convention countries — see https://www.hcch.net for current member list).
- Adjudication in India — Section 32-A, Indian Stamp Act, 1899 (state amendments) — stamp duty paid within 3 months of arrival in India.
- Registration — Section 17, Registration Act, 1908, where the POA empowers transactions in immovable property worth more than Rs. 100, or for litigation in some states.
NRI specifics
POAs executed by NRIs must comply with Foreign Exchange Management (Acquisition and Transfer of Immovable Property in India) Regulations, 2018 (FEMA 21(R)/2018) read with RBI Master Direction No. 11/2017-18 (updated 2025) where the underlying transaction involves immovable property. We draft the POA so that consideration flows through your NRO/NRE account and repatriation stays within the USD 1 million per financial year LRS-NRO limit. Where the POA is for sale of property, Section 195 TDS and Form 15CA/15CB are coordinated with your CA at the deed stage.
When you need a Special vs General POA
- Sale of a specific property → Special POA (preferred; courts and sub-registrars accept it more readily).
- Multiple ongoing matters (rental, litigation, accounts) → General POA, time-limited and with a revocation clause.
- Pure court representation → Vakalatnama plus a narrow SPA — different document, different process.
What you'll receive
- Drafting of Special or General POA tailored to your transaction.
- Country-specific execution instructions — Hague apostille route vs. Indian consulate attestation route.
- Adjudication coordination with the Collector of Stamps in the property's jurisdiction within the 3-month statutory window.
- Registration at the sub-registrar's office where the POA empowers transactions in immovable property.
- Revocation deed drafting, if and when you decide to terminate the POA.
What we'll need from you
- Passport copy, OCI/PIO card, foreign address proof.
- Country of residence (we will confirm if it is a Hague Apostille Convention signatory).
- Full details of the attorney (the person in India you are appointing): name, address, ID proof.
- Scope: what powers are needed (sell, lease, litigate, operate accounts, register documents, etc.).
- Property details and city of jurisdiction, if the POA is for a specific transaction.
