What This Service Is
If your property rights are in dispute, and no special court like RERA (which handles real estate regulation), Consumer Court (which deals with consumer complaints), or NCLT (which handles company matters) can help, filing a civil suit with a District Court or High Court is your main option. This is how you can ask the court to declare you own the property, get back possession of it, make someone do what they promised (specific performance), or stop someone from harming your property permanently.
Legal cases under the Specific Relief Act (the law that covers remedies for civil wrongs) and the Code of Civil Procedure (the collection of laws that tell courts how to handle civil cases) are public and permanent. The main complaint (called a plaint) and all other documents you file become the evidence for your entire case. These cases can take years to resolve. If your plaint is flawed, for example, by missing a 'cause of action' (the legal reason you have the right to sue) or leaving out a necessary party (someone who must be part of the lawsuit), it can ruin an otherwise strong case.
What the Service Entails
The main complaint you file (the plaint) is the foundation of your entire case. If there are mistakes in it, you might not be able to fix them later, especially after the other side files their defense (called a 'written statement'). We start by figuring out the correct cause of action for you, whether it's for declaring ownership, making someone fulfill a contract, getting possession, or stopping an action. We check the 'limitation period' (the time limit you have to file your case) for each of these. We also confirm that everyone who needs to be part of the lawsuit is included.
Next, we design your plaint. This includes clearly describing the property, listing the facts in numbered paragraphs, stating the exact legal help you want from the court, calculating the 'court fee' (the amount you pay to file the case), and preparing the application for a temporary court order (interim injunction). For the interim injunction, we carefully explain why the 'balance-of-convenience' (meaning the greater good) and 'irreparable-harm' (meaning damage that cannot be fixed later) favor you. We review the first draft of your plaint to make sure it's consistent and follows all rules. After we discuss your strategy for the court hearing—especially for the temporary injunction, where an early order can be more helpful than the final judgment—we will give you the final, ready-to-file plaint with all necessary attachments.
Our Specialized Inputs
Our team has experience, including working as expert witnesses appointed by the Supreme Court in major property lawsuits, such as the Supertech Twin Towers case. We help you choose the strongest legal reason to sue when you have several options. For example, we might advise you whether to file a case for specific performance, a case for declaring ownership and getting an injunction, or a separate case just for possession. This advice considers the different time limits and the evidence each type of case requires. We also guide you on how to handle related cases. We can help you coordinate a civil lawsuit with a pending consumer complaint or RERA matter to achieve the best possible outcome.
