What This Service Is

Family transfer documents — like Gift Deeds, WILLs, Relinquishment Deeds, and Partition Deeds — are the main legal tools for giving property to family members or passing it down through generations. Different laws govern each document. For example, the Transfer of Property Act covers gifts, and the Indian Succession Act covers wills. Each type of document has its own rules for stamp duty (a tax on legal documents), income tax, and how it affects ownership. Picking the wrong document, or writing it poorly, can make the transfer invalid. It could also lead to expensive court cases many years later.

What the Service Entails

Family property transfer documents have specific rules about stamp duty, income tax, and property ownership. Choosing the wrong document, or mixing them up incorrectly, can make your transfer invalid. It can also cause costly legal battles years later. First, we will examine your family structure, the type of property you have (whether it's inherited, self-acquired, or belongs to a Hindu Undivided Family), and what everyone involved wants to achieve. This helps us decide which document, or combination of documents, best suits your family's goals. We will map out your complete family tree and ownership history. This lets us find everyone whose agreement or signature is legally necessary. From this information, we will create the document. This includes the 'recitals' (statements that explain the relationship and intention behind the transfer), the 'operative clauses' (sections that clearly define what property is being transferred and how much), any conditions or limits, and how it affects income tax (such as exemptions under Section 56 of the Income Tax Act). We check each part to make sure it can be registered and that it makes sense overall. Then, we will share a first draft with you. After we discuss your specific concerns and make any changes, we will give you the final document, ready for signing.

Our Specialized Inputs

A Gift Deed — a legal document that transfers ownership of property without payment, defined in Section 122 of the Transfer of Property Act — cannot usually be taken back. We will advise you whether to add a 'Revocation Clause' (a section that lets you cancel the gift) under Section 126 of the Transfer of Property Act. We will write it carefully to protect you, the giver, without making the gift invalid. For WILLs — a legal document stating who inherits your property after you die — we ensure it follows the rules of the Indian Succession Act. We also address the 'rule against perpetuity' (a rule that prevents property from being tied up forever), 'Life Interest clauses' (sections that grant someone the right to use property for their lifetime), and how to choose an 'executor' (the person who carries out the will). For relinquishment deeds — a document where a co-owner gives up their share in a property — we check the full family lineage of all co-owners. This prevents a missing heir from making the deed invalid years down the line. For partition deeds — a legal document that divides shared property among co-owners — involving Hindu Undivided Family (HUF) property, we address the tax implications under Section 171 of the Income Tax Act.

What you'll receive

  • You will receive an analysis of your Gift Deed to ensure it's a complete transfer and to confirm if it's a gift or a sale.
  • You will get your WILL prepared, ensuring you have the legal right to make it, naming an executor, and making sure it's ready for probate (the legal process of proving a will).
  • You will receive an analysis of your Relinquishment Deed to understand each co-owner's share and confirm it's a relinquishment, not a sale.
  • You will get your Partition Deed prepared, including a detailed list of property divisions, calculation of shares, and guidance on updating property records.
  • You will receive advice on how to pay the least stamp duty and a checklist to help you register each type of deed.
