What This Service Is

We will help you draft or review a complaint about problems with a builder or property developer. You can file this complaint with the District, State, or National Consumer Commission.

The Consumer Protection Act 2019 — the law that protects consumers — replaced an older law from 1986. This Act is a strong tool property buyers often don't use enough. It helps when you face builder delays, false statements, poor construction, or unfair business practices.

Unlike RERA — the Real Estate Regulatory Authority, which is led by regulators — the Consumer Protection Act lets you directly bring a case before a special court. This court can award you money for emotional distress, legal costs, and special fines. It can also order a refund or give you possession of your property.

Your complaint goes to the correct court based on the total value of the goods or services in question:

  • District Commission: For values up to ₹50 lakh (5 million Indian Rupees).
  • State Commission: For values up to ₹2 crore (20 million Indian Rupees).
  • NCDRC (National Consumer Disputes Redressal Commission): For values above ₹2 crore.

What the Service Entails

Before we write anything, we make three key decisions that will affect your consumer complaint's success:

  1. The correct court to file your case.
  2. The correct legal reasons for your complaint.
  3. Precisely how much money or action you are asking for.

We start by finding the right court for your case. This includes looking at the money involved and the location.

Then, we identify all legal grounds under the Consumer Protection Act 2019 that you can act on. This includes bad service, unfair business practices, or misleading claims.

We also calculate every type of loss you can recover. This includes refunds, interest, getting possession of your property, emotional distress, and legal costs.

Next, we design your complaint. We explain your relationship with the builder. We describe the specific problems you faced, presented in a clear timeline. Your request for relief will aim to get you the most money or action under every available category. For delays, we calculate the compensation you should get, including interest from the date the builder defaulted.

We will review the first draft of your complaint to make sure it is complete. We will then share it with you. After discussing the builder's likely defenses and preparing you for the first court hearing, we will give you the final complaint. It will be ready for filing and will include all necessary attachments.

Our Specialized Inputs

We check if the builder's actions count as an “unfair trade practice” under Section 2(47) of the Consumer Protection Act 2019. This includes misleading advertisements, false statements about amenities or completion dates, or refusing to honor legal guarantees. This is often a more powerful legal argument than just a simple delay.

We also advise you on how cases under the Consumer Protection Act and RERA — the Real Estate Regulatory Authority — work together. We help you decide whether to pursue cases at the same time or one after the other. We also explain how to enforce RERA awards in Consumer Commission proceedings.
