What This Service Is

Contractors often send inflated bills for extra work, ask for more time without good reason, and use arbitration — a way to resolve disputes outside court — to push for payments. If you, as an owner or developer, don't have a strong technical and legal response, you might end up paying claims you don't owe or facing unfair arbitration decisions.

This service gives you a full plan to defend yourself. We review your contract, analyze the contractor's claims, find the weak points in their legal and technical arguments, and suggest a defense strategy.

What the Service Entails

First, we will review the construction agreement — your contract with the builder. We'll also look at the contractor's claim or notice, all orders for changes in work, progress reports, and payment certificates. Second, we will prepare a preliminary defense analysis. This report identifies your strongest arguments and any weaknesses in the contractor's claim. Third, you'll have a 60-minute discussion with an attorney to go over this analysis. Fourth, you'll receive a final defense strategy report. This includes a recommended action plan, a draft response to their notice or an arbitration defense (if you request it), and a checklist of evidence you'll need.
