What This Service Is

When you challenge a court decision about your property, we check your appeal or revision petition before you file it. This makes sure you identify all reasons to challenge the decision. We confirm these reasons are based on the court records and fit the legal rules for review. For a second appeal, the High Court only looks at significant legal questions. If your challenge does not raise such a question, the court will reject it immediately.

What the Service Entails

When we review your appeal documents, we carefully separate factual errors (which you can only challenge in a first appeal) from legal errors (needed for a second appeal or revision). We ensure any "substantial question of law" — a significant legal question that allows the High Court to hear your case — is clearly stated. If your appeal doesn't raise a substantial question of law, the court will dismiss it right away. This means you cannot argue that point again. IndiaPropLaw checks every reason you list to make sure it's supported by the court records. We also ensure it meets the legal requirements for that stage of appeal. We will point out any reasons that the court cannot consider at that appeal level. We also identify any important points you missed that should be included. We will send you a Preliminary Vetting Report first. After we discuss our findings and how to improve your arguments, you will receive a Final Vetting Report with our suggested changes highlighted.

Our Specialized Inputs

We determine if your appeal correctly separates factual errors (allowed only in a first appeal) from legal errors (required for a second appeal and revision). Mixing these up is very common and often leads to second appeals being rejected without a full review.

What you'll receive

  • We will analyze the lower court's decision, identify the reasons for your appeal, and check if you are filing within the deadline for a first appeal.
  • We will help you clearly define the 'substantial question of law' for your second appeal, as required by Section 100 of the Civil Procedure Code — the law about legal procedures in civil cases.
  • We will outline the reasons for your civil revision, focusing on errors in how the court handled the case or improper procedures.
  • We will draft applications to temporarily stop the lower court's order while your appeal is pending.
  • You will receive a brief summary of your case to help your lawyer understand the details quickly.

What we'll need from you

  • You will need to provide a certified copy of the order, judgment, or decree — the official court decision you are challenging.
  • We need the complete court records from the trial court. This includes all pleadings (formal statements to the court), evidence, documents, and written arguments.
  • Tell us your reasons for challenging the decision. What specific legal or factual errors did the lower court make in its findings?
  • Provide the full names, addresses, and descriptions of all parties involved in the case.
  • Please tell us the exact date you received the official court decision. This is important to ensure your appeal is filed on time.
